Court Denies Petition To Question Zuckerberg and Banks About Alleged Facebook IPO Fraud

Today a Texas court dismissed a petition asking for "oral depositions and requests for documents" from Facebook to determine if it defrauded investors in its IPO last month. The judge ruled that the plaintiffs needed to already have grounds for a complaint against Facebook, and could not use a petition for discovery in order to figure out the basis for a lawsuit, according to government documents attained by TechCrunch. The petition sought to grill CEO Mark Zuckerberg, CFO David Ebersman, Chief Accounting Officer David Spillane, and representatives from Morgan Stanley, J.P. Morgan, and Goldman Sachs for info about whether they withheld negative financial data about Facebook from the public before its IPO. Facebook remains embroiled in several other lawsuits with similar complaints, though.
Twitter Turns Its Tweet Firehose On For Saleforce's Radian6 In New Enterprise Deal

As enterprise companies like Salesforce and Oracle continue to sharpen their social media services for enterprises, Twitter is locking arms with one of them in a strategic alliance. Radian6, the social media monitoring service bought by Salesforce in March 2011 for $326 million, has announced that it has signed a strategic alliance with Twitter that gives Radian6 customers "complete access" to Twitter's public tweet firehose of more than 400 million tweets per day. Google Will Update Chrome For Apple's New Retina Displays, Already Available In Canary Build

Apple's new MacBook Pro with Retina display definitely pushes the idea of what a modern screen should look like forward, but it also means developers will have to adapt their apps to these high resolutions to make sure their apps don't look bad. During its announcement earlier this week, Apple said that both Adobe and Autodesk were already working Retina-optimized versions of their products (though both now say that it will still be a while before their software will be ready). It looks like Google will be a bit faster. The company today announced that its first attempt at making Chrome ready for these high-resolution displays is already available in its highly experimental Canary channel. Google says it is "committed to polishing Chrome until it shines on that machine."

Soundcloud Turns Up As An Expanded Tweet Partner For Audio

SoundCloud just revealed itself as an expanded tweets partner. SoundCloud's HTML5 widget will show up in tweets that contain a SoundCloud url. This means that Twitter cards will display a summary of SoundCloud sounds right inside a tweet allowing anyone to follow both the Soundcloud platform and any Soundcloud content creator directly within the expanded Tweet.
Apple's Passbook Could Be A Platform, Not Just Another Mobile Payments Rival

At this week's WWDC, Apple introduced a new application called "Passbook," meant to function as an organizer for all your passes. It supports store cards, gift cards and coupons out of the gate, replacing their plastic counterparts, and providing an Apple-approved way to get consumers paying at checkout with their mobile phones. At first glance, it seems that Passbook's launch is bad news for mobile wallet players like Square, PayPal, and others. But it might actually represent an opportunity for everybody else. Besides the gee-whiz factor of having scannable cards organized in a pretty interface within the iPhone, the most interesting thing about Passbook is that the digital cards are able to make use of the iPhone's geolocation capabilities. "When you get to the movie theater, your ticket automatically pops up on the lockscreen," explained Scott Forstall, Apple's SVP for iPhone software, demonstrating how a Fandago movie ticket in action.
Facebook Exchange: A New Way For Advertisers To Target Specific Users With Real-Time Bid Ads

Facebook is testing and will soon launch Facebook Exchange, a real-time bidding ad system where visitors to third-party websites are marked with a cookie, and can then be shown real-time bid ads related to their web browsing when they return to Facebook. This retargeting option could be a huge money maker for Facebook as it will allow for more relevant direct advertising. For example a travel site could serve ads about a flight to Hawaii to someone who almost bought a flight on their site. Advertisers might pay big premiums for highly-accurate targeting. Users will be able to opt out of Facebook Exchange via third-party demand-side platforms, but they can't opt out of the program completely from within the social network.
Twitter Launches Expanded Tweets, Letting You Read News, Check Out Images, And Watch Video Inline

On the Twitter blog today, the company announced a new way that users will be able to get access to an expanded array of content from partners. The latest new innovation, Expanded Tweets, will let users check out content directly from certain partners, without having to leave its web site. News partners like the NY Times, Wall Street Journal, MSNBC's Breaking News, San Francisco Chronicle, Der Speigel, and TIME will now let users see more content directly within their Tweets, without having to click through to their websites. When you expand a news-based Tweet, for example, Twitter's Expanded Tweets will provide a preview of the headline and introduction, as well as the Twitter accounts of the publisher and writer. They can then click through to read the article, follow news accounts, reply or retweet within the Twitter page itself.
Another Revenue Stream For Flurry As It Works With Activision To Publish Mobile Games

So very much data. And what to do with all of it? San Francisco's Flurry has its mobile analytics in 190,000 apps on Android and iOS. And as the mobile app ecosystem has matured with Apple now paying a cumulative $5 billion to developers, Flurry has used its data to power everything from mobile video ads to pay-per-install. Now the company is dipping its toes into game publishing. The company is partnering with an arm of Activision, which is behind the Call of Duty franchise, to publish mobile games. Activision, which is better known for its visceral console and PC games, has yet to make a big move into mobile gaming. But this looks like it could be part of it.

Microsoft threw some of us for a loop when they launched the Metro-fied My Xbox Live app for iOS late last year, as it was the first time Xbox Live support had officially made it to any mobile platform aside from Windows Phone. With The ARK Challenge, Northwest Arkansas Gets An Incubator Of Its Own

It seems like there are tech accelerators and incubators popping up all over the place, spreading from major tech hubs like San Francisco and New York throughout the U.S. and internationally. But now they're also appearing outside of major metro areas. Take The ARK, for instance, an incubator program that's just getting started in Northwest Arkansas. The ARK Challenge is looking to recruit 15 startups, who will get all the same things you can expect from accelerators elsewhere, including funding, coworking space and access to mentors. All chosen to participate will receive $18,000 in funding in exchange for 6 percent of equity, and will have the opportunity to work out of the Iceberg CoWorking Space in Fayetteville, Ark.

President Obama will sign an executive order tomorrow that will make the construction of broadband networks along federal roadways and properties easier and, according to the White House, 90% cheaper. This is only one part in the White House's new push to improve broadband in the United States. In addition, the White House is also launching its "US Ignite" initiative that actually feels somewhat similar to what Google is doing with its Google Fiber project in Kansas City. US Ignite's mission is to spur the development of "next-generation applications and digital experience" that will we able to make use of state-of-the-art broadband networks running 100 times faster than today's Internet connections."
Solar Mosaic Gets $2 Million DOE Grant To Build Out Crowdfunding Site For Solar Projects

Solar Mosaic, a startup that's aiming to be the "Kickstarter for solar projects," has been awarded a $2 million grant from the United States Department of Energy (DOE) Sunshot Initiative. Solar Mosaic, which also goes by simply Mosaic, is building an online platform that facilitates crowdfunding of solar projects. Last month the Oakland, California-based company closed on a $2.5 million Series A funding round led by Spring Ventures.

With Android devices occupying nearly every niche, manufacturers are left with the odious problem of figuring how to give their products a fighting chance in a crowded market. Clipping Virtual Coupons On The Go: RetailMeNot Launches Its First iOS App

The popular coupon site RetailMeNot launched its mobile site earlier this year and today, the company is launching its first native app for iOS. The new app allows users who don't like to pay full price to find online and in-store coupons. Users get access to curated lists of popular coupons and "hot deals." They can also bookmark coupons for what the company calls "time-shift shopping." According to the company's own data, its site already gets about 17% of its traffic from mobile users. Its mobile channel, says the company's CEO Cotter Cunnigham, is growing "by 200% every month year-over-year."
YouSendIt Now Lets Yahoo Mail's 310M+ Users Easily Share Big Files

YouSendIt, the file transfer and business content collaboration service, has been trucking along of late, in spite of competition from plucky upstarts like Box. The startup has 98 percent of Fortune 500 companies on board in some form or another, and last we heard, YouSendIt had over 600K paying customers along with 30 million registered users. In May, the company found a new CEO in Brad Garlinghouse, the former head of consumer products at AOL. Prior to AOL, the exec spent five years in various senior positons at Yahoo. Peanut butter manifestos notwithstanding, the CEO (and team) has parlayed past connections into a significant partnership with his former employer.

Patchy Response From Sites Aimed At Kids In The Wake of Habbo Controversy

In the wake of the disturbing news that teen site Habbo Hotel had hosted illicit and inappropriate content, the response from other sites aimed at teens and younger children has been patchy at best. Yesterday UK broadcaster Channel 4 published allegations that the site was playing host to pornographic sexual chat, despite being aimed at children as young as 13 years old. We asked similar sites what they were doing in the wake of the Channel 4 story, some of them startups.
